    PRIVACY POLICY
    This privacy policy describes the personal data collected or generated (processed) when you interact with DAN Europe Foundation through our websites, our shop, our mobile applications, events, or through any of our other products or services accessible from the site. It also explains how your personal data is processed, shared, and protected, what choices you have regarding your personal data, and how you can contact us if you have questions.

    3- Which personal data are collected
    The owner requires some personal data to provide access to the shop and to purchase products or services requested. Data are also requested in order to answer to requests for information. In addition, when you request specific services/products of the shop, the owner may ask you to log in to your account for providing the services that are associated with the account itself opened (MyDAN).
    This personal data includes:
    • contact information including name, email, phone number, shipping address;
    • billing address;
    • login and account information including username, password, and unique user ID;
    • personal information including gender, hometown, date of birth, and purchase history;
    • payment method information;
    • information needed to purchase products, such as desired size.
    • personal preferences including your wish list, marketing, and cookie preferences (check our cookie policy).

    In compliance with local regulations, we do not allow registration in our shop to those who have not reached the minimum age established by the law of their country of residence. For the purchase by minors will be required the consent of parents.

    4- For what purposes we process the data collected
    We use personal data for the following purposes:
    • A- To ensure the best functionality of the requested services:
      while using our features in the shop, we use your personal data to provide the requested product or service. For example, if a purchase is made, or you take part in an event or promotion, we use the information you provide to communicate about the purchase, event, or promotion. If you contact our customer services, we use certain information about you, such as delivery or payment information, or information about the product that was purchased, in order to help you solve a problem or answer a question.

    • B- To communicate information about our products, services, events and for other promotional purposes.
      • I) After obtaining your consent, we will send marketing communications and news about products, services, events, and other promotions that may be of interest to you. Such consent may be revoked at any time. Revocation will not affect the prior activity of the Controller. We specify below how we may act:

      • II) Direct Marketing.If you are already a member of DAN Europe Foundation (e.g., if you have placed an order with us, or have already opened your MyDAN profile), we may use the contact details you provide at the time of purchase to send you communications for marketing purposes about similar products or services, where applicable (unless you have opted out of receiving such communications). In other cases, we will require your consent to send marketing communications.

      • Personalization (or profiling).We may use the information that you provide and information about other products or services, your visits or purchases, participation in events and promotions, to personalize communications about products and services that may be of interest to you. By doing so, we may combine the information you have provided with information we have generated in connection with your online activity, including internal analytics and insights.

    • C- To conduct, improve, and maintain our business, products, and services.
      We use the information you provide to run our business. For example, when you make a purchase, we use that information for accounting, auditing, and other internal functions. We may use personal information about your use of our products and services to improve your experience, to diagnose technical and service problems, and to better manage our shop.

    • D- To protect our or a third party's rights, property, or safety.
      In addition, we may use personal information in connection with your use of the shop to prevent, detect or investigate fraud, abuse, unlawful use, violations of our Terms of Use and to comply with court orders, requests from regulatory authorities or applicable law.

    • E- For general research and analysis purposes.
      We use data about visitors' use of our shop and services to understand customer behaviour or preferences. For example, we may use information about how shop visitors search for and find products to understand how best to organize and present products in our stores.

    • F- Other Purposes.
      We may also use personal data in other ways and at the time of collection of the same we will give specific notice and request your consent where necessary.


    5- On what legal basis do we process personal data.
    We process personal data as required by law depending on the type of interaction with our shop.
    • I) When you purchase products from the shop, your personal data is necessary to allow us to fulfil the contract (both pre-contractual and contractual) that we have with you. For example, a request for information about a size, as well as payment and contact details are necessary to clarify doubts about the purchase and proceed to the delivery of the order.

    • II) When we send marketing emails or invitations to promotions, we do so because we have received your prior consent.

    • III) We also apply other legal bases, such as our legitimate business interests, to process data about the effectiveness of our marketing campaigns, products, services, events, and other promotional initiatives; to conduct, improve and maintain our business, products and services; to protect our or others' rights, property and safety; and for general research and analysis purposes. When we process personal data for our legitimate interests, we take appropriate measures - which we are glad to explain upon request - to ensure that the interests we pursue are balanced against your interests, rights, and freedoms.

    • IV) We process your personal data, in addition, to comply with legal obligations or to protect your vital interests.


    6- Tools for managing personal data that is collected
    When you use the Shop, your browser or mobile device platform provides additional tools that allow you to control the collection or sharing of certain categories of personal data by your device. For example, your mobile device or browser may offer tools that allow you to manage your use of cookies. We encourage you to familiarize yourself with all the tools available on various devices and to use them

    7- Data shared by DAN
    DAN Europe Foundation shares your personal data with:
    • I) Companies that are part of the "DAN" group for the purposes and under the conditions described above.

    • II) Service providers who process personal data on behalf of DAN, e.g. to process credit card and payment information, shipping and delivery, hosts, to manage data, to send emails, for research and analysis, to manage product and brand promotions, and to administer certain services and features. When we use third party service providers, we enter into agreements that require them to take appropriate technical and organizational measures to protect personal data.

    • III) Other third parties to the extent necessary to: (i) comply with a public authority request, court order, or to comply with applicable laws; (ii) prevent illegal uses of our shop or violations of our terms and conditions of use or policies; (iii) defend against third party claims; and (iv) facilitate the prevention or investigation of fraud (e.g., counterfeiting).

    • IV) Third-party targeted advertising providers that provide us with customization and tailored advertising services. We use these services to combine aggregated information we hold with personal information in their databases to create personalized audiences and tailor advertising to your interests on the Internet, including social media, as permitted by applicable law. You may opt out of custom advertising and custom audiences by using the relevant settings on our Platform.

    • V) Other third parties, where consent has been granted.

    We may also transfer the personal data we hold in the event of a sale or transfer of all or part of our business or assets (including in the event of a reorganization, spin-off, dissolution, or liquidation).

    8- How we protect the personal data we process
    The data processing is carried out through computer tools and/or paper supports, by subjects committed to confidentiality, with logics related to the purposes and in any case to guarantee the security and confidentiality of the data.

    9- International transfers of personal data
    The personal data that we collect (or process) in the context of the shop will be stored in the European Union. Some of the data recipients with whom we share your personal data may be located in countries other than the country in which your personal data was originally collected. The laws of those countries may not provide the same level of data protection as the country where you originally provided your data. However, when we transfer personal data to recipients in other countries, we protect such personal data as described in this Privacy Policy and in accordance with applicable law.
    We take steps to comply with legal requirements applicable to the transfer of personal data to recipients located in countries outside the EEA, the United Kingdom (UK) or Switzerland that do not provide an adequate level of data protection. We take several steps to ensure that personal data transferred to such countries is adequately protected under data protection provisions; this includes signing EU Model Contractual Clauses or ensuring that the recipient has adopted Binding Corporate Rules. For data transferred within DAN, we use an intra-group data transfer agreement.

    10- Retention of personal data.
    We will retain personal data for as long as is necessary for the purposes set out in this policy on Personal Data Processing (unless otherwise required by law). In general, this means that we will retain personal data for as long as you have an account. Personal data related to the purchase of products (e.g. invoices) are kept longer to fulfil legal obligations (those required by tax and sales regulations and for warranty purposes).

    11- Exercise of rights regarding personal data.
    The user has the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (portability) and to have this information transmitted to another company; (iii) the correction of your personal data if it is incomplete or inaccurate; or (iii) the deletion or limitation of the processing of your personal data in certain circumstances provided for by applicable law. These rights are not absolute, so the Data Controller may have grounds for refusing to exercise them, but in that case, you will be notified of the reasons for denying your request. You have the right to revoke at any time the consent, provided to us, for the processing of personal data.

    Complaints made about the processing of personal data will be evaluated to resolve the problem in a timely and effective manner. In addition, you have the right to file a complaint with the Data Protection Authority in your country of residence.

    CHANGES to our privacy policy
    Applicable law and our practices change over time. If we decide to update our privacy policy, we will post those changes on our Shop. If we change the way we process personal information, we will provide you with notice or, where required by law, you will be asked for consent before implementing those changes. We strongly encourage you to read our privacy policy and keep informed about our practices. This privacy policy was amended in March 2022.
